RE: The Process for Seating a New Board Member & The Annual Organizational Meeting
The vote to elect a new Board member took place on November 5, 2019. Residents of Area 3 selected Catherine Kuo as their representative to the Dublin Unified School District Board of Trustees. Before Ms. Kuo can be seated, the Alameda County Registrar of Voters must certify the election results and has 30 days from the date of the election to do so. The Registrar typically uses the full 30 days to complete this process, which means it is unlikely Ms. Kuo’s results will be certified until early December.
Additionally, Assembly Bill (AB) 2449, which became effective on January 1, 2019, modified Education Code section 5017 (among others) to specify that the term of newly elected Board members shall begin on the second Friday in December.
By law, Ms. Kuo cannot be sworn in until Friday, December 13, 2019, at the earliest. The first Board meeting after the December 13 date will take place on Tuesday, December 17, 2019.
The Board’s organizational meeting, the annual process of establishing the Board officers (President, Vice President, etc.) cannot take place until the date the new board member can be seated (December 13, 2019) or within 15 days later (Ed. Code section 35143). Consequently, the Board’s organizational meeting will have to take place on or after December 13.
Given the timeline realities presented by the Alameda County Registrar of Voters, and the legal restrictions of AB 2339 and Ed. Code section 35143, the Board meeting scheduled for December 17, 2019, shall include the swearing-in of the new board member, Ms. Kuo, and the board's annual organizational meeting.
